Are staff on Whitley Council terms entitled to Agenda for Change?

I started as a partner last month and am faced with staff contract problems. We have long-term staff with 15-16 yrs service and they have realised they are on contracts which state Whitley Council terms. As these have been superseded by Agenda for Change, they are now asking for the same. Do we have the option not to go for Agenda for Change?
