Can I pay my partner daughter's superannuation while she's on leave and not drawing any income?

I am almost a single handed practitioner. My daughter is my partner but since the birth of her child last year, she has requested and I agreed to give her a break for four years. She is not drawing any income from the practice but her superannuation is being paid off at the ratio of 33.33%. Can I legally maintain this state of affairs and; should I pay her superannuation when she is not drawing any income?
