GPs face courts if they breach new cremation laws

GPs face prosecution if they fail to follow cremation laws, a medical defence body has warned.

Under new Crown Prosecution Service legal guidance, GPs who breach death and cremation certification rules will not be dealt with by criminal courts, not the GMC.

Dr George Fernie, medico-legal advisor for the Medical and Dental Defence Union of Scotland, said: ‘If doctors sign a form saying they have viewed the deceased, they must have viewed the deceased, or they're potentially committing a criminal offence.'
