1.22pm. I expect it is simply that the Scottish legal system is different to and independent of the English/Welsh/NI systems as it pre-date the Act of Union. Likewise, the Scots have a different educational system. From the little I know of it, what I hear makes me prefer the Scottish system. e.g. If you take your kid to a playground and they fall off the swing and hurt themselves, you can forget suing the council in Scotland. They have a term for it, which I have forgotten, but they assume that by taking your kid to a playground you shoudl be sensible enough to know there is a danger of falling off something.
