    'Copies to all claimants/appellants/GPs'
    Lack of understanding between 'medical diagnosis' and 'functional ability' is clearly shown by Dr Sherifi's analogy. This illustration would help a lot.
    Many appellants are in 'the system' so as to receive payments till appeal heard.

  • Appellants no longer receive payments until the appeal is heard, which can take over 12 months - all benefits are removed.

  • Some claimants do get ESA until the appeal is heard. The confusion between the new mandatory reconsideration and the actual appeal which follows is causing confusion for some - once an APPEAL is registered the claimant receives the assessment rate of ESA if the appeal is against a decision that they are fit for work following an assessment with a health care professional - if a claimant does not attend an assessment with an HCP then they will not be paid while they appeal.
